DEFINITIONS

  • Account: The user interface on the Website that allows you to manage your BitJeton assets, obtain information related to your transactions, and utilize the Services. It serves as your virtual profile granting access to the Website’s functions and services.
  • Agreement: The electronic contract between BitJeton and the Consumer, comprising these Terms and Conditions (GTCs), Privacy Policy, and all related legal documents.
  • AML Law: Refers to the applicable anti-money laundering laws in the Czech Republic, including legislation on money laundering, terrorism financing, bribery, corruption, tax evasion, and fraud.
  • Consumer: An individual acting outside their business, employment, or occupation when entering into and performing the Agreement.
  • Conversion Service or Conversion: The service provided by BitJeton for converting FIAT currency into Cryptocurrency, converting between different Cryptocurrencies, and converting Cryptocurrency back into FIAT currency.
  • Cryptocurrency: A digital currency utilizing encryption techniques to regulate the creation of currency units and verify fund transfers, operating independently of a central bank.
  • Custody Services: Services provided by BitJeton for the secure storage of Cryptocurrencies owned by the Consumer.
  • Distributor: A registered individual or entity offering additional payment methods to Consumers, as outlined in Article 7 of these GTCs.
  • Fees: All charges imposed by BitJeton for the provision of Services.
  • FIAT Currency: Government-issued currency.
  • BitJeton: BitJeton, s.r.o., IČO 21289875 registered in Cimburkova 916/8, Žižkov (Praha 3), 130 00 Praha, Czech Republic. Contact: [email protected], Monday to Friday from 9:00 a.m. to 5:00 p.m. (Central European Time).
  • Moderator: An individual employed or contracted by BitJeton to resolve issues between Distributors and Consumers.
  • Nominal Value: The designated value of a BitJeton asset as determined by the Consumer in the Order, used as the basis for Conversion into the selected Cryptocurrency.
  • Order: The Consumer’s instruction to purchase BitJeton assets through the Website, specifying the Nominal Value, chosen Cryptocurrency, and payment method.
  • Partner: A business partner participating in BitJeton’s affiliate program, offering BitJeton assets to Consumers.
  • Party: BitJeton and the Consumer who have entered into the Agreement with each other.
  • Provider: BitJeton.
  • Services: Conversion and Custody services.
  • Wallet: A digital wallet provided by BitJeton for storing the Consumer’s Cryptocurrency.
  • Website: The website https://bitjeton.io.

INTRODUCTORY PROVISIONS

These General Terms and Conditions (GTCs) are issued by BitJeton, which holds the relevant authorization for providing virtual currency wallet and exchange services.

These GTCs outline the terms and conditions for using:

  • The Website
  • The Account
  • Conversion services, including the purchase of Cryptocurrency via BitJeton
  • Custody services

By using the Website, you agree to these GTCs and the Privacy Policy by clicking “I agree” during Account registration. If you do not agree, do not use the Website or the Services.

Any legal relationships not explicitly covered by these GTCs will be governed by the applicable laws of the Czech Republic unless otherwise stated.

ACCOUNT REGISTRATION

Consumers must open an Account before using Services. Provide a valid email address to complete registration. BitJeton may refuse to open an Account at its discretion. Consumers must provide accurate and complete information and update it promptly.

By registering, you represent and warrant that:

  • You are at least 18 years old
  • You are not resident in or attempting to access the Website from Restricted countries
  • Your transactions on the Website are for trading purposes
  • You are not a politically exposed person
  • The funds or property used in this business relationship are your own
  • You act in your name, not as an agent for any third party

CUSTOMER IDENTIFICATION AND VERIFICATION

BitJeton, as an obliged entity under AML Law, must verify your identity to prevent money laundering and terrorist financing. This includes requesting supporting information and documents. Verification is performed using third-party solutions, including biometric identification or artificial intelligence.

BitJeton reserves the right to withhold or cancel transactions until statutory AML conditions are fully satisfied.

ORDER AND REDEMPTION OF BITJETON ASSETS

The Agreement is entered into by placing an Order and becomes valid when the Order is placed by the Consumer. These GTCs form an integral part of the Agreement.

Please note that the validity of BitJeton assets is limited to 180 (in words: one hundred and eighty) days from the moment they are generated. The ability of the Consumer to use the BitJeton asset for the first time will be considered as the point of delivery for the purposes of these GTCs. Upon expiration of the 180-day validity period, the option to redeem the BitJeton asset will be lost. By not redeeming the BitJeton asset within its validity period, you tacitly consent to the transfer of its Nominal Value to BitJeton.

DISTRIBUTORS

BitJeton collaborates with Distributors to expand payment methods. Distributors can create a profile and offer payment methods to Consumers. Legal relationships between Distributors and Consumers are governed by mutual agreement, and BitJeton is not a contractual party.

RESTRICTIONS ON BITJETON ASSETS

BitJeton reserves the right to restrict BitJeton assets if:

  • They are used in violation of the law or GTCs
  • They were acquired unlawfully
  • They have expired

BitJeton assets cannot be used to purchase other assets, goods, or services, or be converted back into FIAT currency.

PROVISION OF SERVICES

BitJeton provides Conversion and Custody services under these GTCs. Conversion services include converting FIAT currency into Cryptocurrency, converting between different Cryptocurrencies, and converting Cryptocurrency back into FIAT currency. Custody services ensure the secure storage of Cryptocurrencies.

FEES

Services are charged according to the List of Fees available on the Website. BitJeton reserves the right to change Fees with 14 days’ notice to the Consumer. Fees include transaction percentages or flat fees and may involve third-party service provider charges.

WITHDRAWAL FROM THE AGREEMENT

Consumers can withdraw from the Agreement within 14 days of delivery of the BitJeton assets, provided they have not been redeemed. Withdraw by using the withdrawal form or sending an email to [email protected]. The right to withdraw does not apply to Consumers outside the EU.

LIABILITY OF BITJETON

BitJeton strives to provide continuous service but is not liable for unavoidable technical obstacles or force majeure events. Liability for losses or damages due to service interruptions or terminations is excluded. BitJeton backs up all data but is not liable for data loss caused by the Consumer.

CLAIMS AND COMPLAINTS

Consumers can file claims for service failures or defects to [email protected]. Claims will be resolved within 30 days. Unresolved complaints can be escalated to alternative dispute resolution entities or courts.

COMMUNICATION, NOTICES, AND DELIVERY

Notices should be sent to [email protected] or by registered mail to BitJeton’s address. Electronic delivery is deemed complete the day after dispatch.

RESOLUTION OF DISPUTES AND JURISDICTION OF COURTS

Disputes should be resolved out of court, but unresolved disputes will be addressed by the courts under Czech law.

CHANGES TO THE GTCs

BitJeton reserves the right to change these GTCs for legal, technical, or service-related reasons, with 2 months’ notice. Rights and obligations can be assigned with prior notice, while Consumers must agree to assignments affecting service quality.
